7. Pleasanton shall undertake steps to amend its westerly <br />Sphere of Influence to the westerly edge of the existing lots of <br />record at or adjacent to the top of the Pleasanton and Main <br />Ridges, as identified on Exhibit "A." <br />8. The parties shall use best efforts to keep any future <br />Castro Valley Sphere of Influence out of the Ridgelands Area. <br />9. Hayward shall use its best efforts to detach the <br />properties within Pleasanton's Sphere of Influence, as amended by <br />paragraph 7. <br />ACCE88 TO PIIBLIC LANDS <br />10. The parties will encourage the East Bay Regional Park <br />District to provide public access to Ridgelands Park from as many <br />points as feasible, including Foothill Road, Palomares Road, and <br />Dublin Canyon Road, in order to maximize public access and to <br />distribute the traffic impacts of staging areas among surrounding <br />jurisdictions. <br />il. The parties will encourage the East Bay Regional Park <br />District to obtain public access to the Ridgelands Park from <br />either the northwest end of Palomares Road (e.g., via Cowing <br />Road) or from Dublin Canyon Road (e.g., in the vicinity of <br />Shaeffer Ranch Road) which allows automobile access from I-580, <br />and to work with property owners to obtain improvement of these <br />access roads serving the park. <br />12. The parties will work together to provide emergency <br />access from Santos Ranch Road (in Pleasanton), Foothill Road (in <br />Pleasanton), Kilkare Road (in Sunol), and Palomares Road (via <br />Cook Canyon Road in Hayward and Alameda County). <br />13. The parties will work together to provide, where <br />feasible, access and/or a staging area to connect any new <br />development within or adjacent to the Ridgelands Area with <br />Ridgelands Park. The parties shall support efforts to provide <br />pedestrian (hiking trail) access to Ridgelands Park. <br />THIRD PARTY CHALLENGES <br />14. If any legal action or proceeding is instituted <br />challenging the validity of this Agreement, the parties shall <br />cooperate in defending against such challenge. However, Hayward <br />and Pleasanton shall jointly and severally be obligated to <br />provide the County with legal counsel for its defense, and to pay <br />any litigation expenses. In addition, Hayward and Pleasanton <br />shall be jointly and severally liable to pay any award of costs <br />and attorneys' fees made against the County and in favor of any <br />third party plaintiff or petitioner in such a challenge.
