WHEREAS, this cooperative effort has produced a consensus of <br />objectives and policies for the Ridgelands Area which will ensure <br />the preservation of permanent open space, recognize existing <br />development and the potential for limited future development, and <br />provide for improved access to public parklands; and <br />WHEREAS, County is concerned about exposure to the cost of <br />defending litigation that might be filed to challenge adoption of <br />this MOU and Hayward and Pleasanton, cognizant of the disparate <br />impact recent State budgets have had on County, wish to hold <br />County harmless from certain potential litigation expenses. <br />NOW, THEREFORE, in consideration of the mutual promises <br />expressed herein, the parties agree as follows: <br />LAND IISE <br />1. Each of the parties shall use its best efforts to adopt <br />into its respective General Plan the goals and policies set forth <br />in Exhibit "B." <br />IMPLEMENTATION <br />2. The parties shall support each of the other parties' <br />efforts to incorporate the goals and policies set forth in <br />Exhibit "B" into their respective General Plans. <br />3. If the General Plan of each party is amended as <br />provided in paragraph 1, above, then any further amendment to <br />that portion of each party's General Plan applicable to the <br />Ridgelands Area shall provide that said amendment shall not be <br />effective unless there are parallel amendments adopted by the <br />other parties. <br />4. The parties shall work together to create parallel <br />zoning regulations for building sites, single family homes and <br />other private uses within the Ridgelands Area. <br />5. The parties shall refer all proposals within the <br />Ridgelands Area (land use action, private road approval, land <br />purchase, public park plans, etc.) which may affect surrounding <br />communities (including Dublin, Castro Valley, Fremont, or Union <br />City) to the appropriate jurisdiction for review and comment, and <br />shall consult with each other and the East Bay Regional Park <br />District prior to taking action. <br />BOIINDARY ADJIISTMENTS <br />6. Hayward's easterly Sphere of Influence line, as <br />identified on Exhibit "A," shall remain unchanged. <br />- 2 - <br />
