necessary by the City T4anager. Developer agrees to participate <br />in the funding of such apparatus, manpower and other facilities <br />in whichever manner best achieves the maintenance of existing <br />levels of fire service through timely additions of fire safety <br />equipment facilities and personnel, as determined by City. <br />In determining the level of participation of such funding <br />agreed to herein, City shall take into consideration the project's <br />contribution towards fire services in its ordinary eont.ributon <br />towards funding city services generally (via taxes, etc.). <br />VI. DEVELOPER'S RIGHTS <br />With reference to each of the agreements contained.herein <br />to place subject site into one or more assessment districts,' <br />benefit districts, or other district or funding mechanism requir- <br />ing approval of all or a majority of properties so included, the <br />developer agrees to either (1) not protest the establishment of <br />the district or (2) to affirmatively vote for the creation of <br />the district or other mechanism, depending on the manner of <br />creation of the funding mechanism. However, Developer retains <br />the right to protest that the allocation of costs among various <br />properties is inequitable under any of the above-mentioned funding <br />mechanisms. <br />In the event the assessment mechanism appears to impose <br />economically infeasible levels of cost upon the project site, the <br />City agrees to explore alternate financing methods. <br />VII. PROJECT COTv'DIT-IONS <br />clothing herein shall lessen any obligation of Developer <br />required as a condition of project approval. As a further <br />-5- <br />
