via Hearst Drive. In the event that Hearst Drive is blocked, they would have the other <br />access on the fire road from the water tank. It was staff’s collective opinion that there <br />were adequate means out of the site, which enabled staff to make the recommendation to <br />make that finding. <br /> <br />Commissioner Pearce noted that page 33 of the staff report discussed wetlands and <br />waters and inquired if one of the potentially impacted areas was the swale which <br />Property #51’s permitted bridge would be going over. Mr. Pavan confirmed that the <br />bridge will go over that area, but that would require review by the Regional Water <br />Quality Control Board and the Department of Fish and Game. He noted that the Army <br />Corps of Engineers also had jurisdiction. <br /> <br />Chairperson Fox noted that in August 2006, when the Draft EIR was completed, she had <br />sent an email to the Parks and Recreation Commission about the trails not being <br />accessible, and the staging area being moved. She expressed concern about No. 10 on <br />page 39 of the Environmental Findings and Statement of Overriding Considerations <br />which reads, “Provide for a system of trails in the Oak Grove Open Space for use by Oak <br />Grove and Kottinger Ranch owners.” She thought it had been determined that those <br />would be provided for the general public. <br /> <br />Mr. Pavan noted that the proposal included a local and regional trail, which would <br />interlink this project with open space areas in the Vineyard Corridor area, as well as open <br />space areas to the south. These public trails would be primarily available to the <br />immediate residents of this development, as well as Kottinger Ranch. The trails are <br />public and fit into the City’s overall plan for a Citywide public trail system. <br /> <br />Ms. Decker added that it was an error in the documentation stating that the trails were <br />limited simply to Kottinger and Oak Grove Ranch. She apologized for the confusion <br />caused by the error. <br /> <br />A recess was called at 8:50 p.m. <br /> <br />Chairperson Fox reconvened the meeting at 9:05 p.m. <br /> <br />Chairperson Fox disclosed that she met with the applicant and walked the site with the <br />applicant in the previous summer. She also met with Tom Pico and several neighbors in <br />the Grey Eagle Estates development.
