•. • • • > <br />~ 1 <br />through this agreement and finds that it is in the public <br />interest to allow Developer to proceed in advance of their <br />completion. <br />.NOW, THEREFORE, City and Developer hereby agree as <br />follows: <br />I. TRAFFIC FACILITIES <br />Developer agrees to place the project site into an <br />assessment district or districts for the construction of all <br />of the facilities necessary for the amelioration of traffic <br />congestion caused by .development of the project including <br />its direct and cumulative traffic impact. Facilities may be <br />those described in the Pdorth Pleasanton Traffic Studies, <br />Volumes I, II and III, the Traffic Impact Analysis-Stoneridge <br />Center, April 15, 19821, or other facilities deemed necessary <br />by the City. The assessment district or districts shall be <br />formed at the time deemed necessary by the City. <br />II. WATER SERVICE STUDY <br />Developer agrees to participate in the funding of a <br />comprehensive water study of the Plorth Pleasanton area <br />designed to identify short- and long-term improvements <br />necessary to achieve adequate water supply and pressure, <br />said study being in progress at this time. The Developer's <br />share of the total cost of the study may be made a part of a <br />subsequent assessment district, at the discretion of the <br />City. In the event said study costs are not made a part of <br />an assessment district, Developer shall pay to the City the <br />Developer's share of the total cost, an amount not to exceed <br />$10,000.00, within one month of notification by the City <br />-3- <br />
