Ala-580- KY R34.1/R35.4 (PM R21.2iR22,0) AMENDMENT TO FREEWAY MAINTENANCE AGREEMENT This Amendment to Freeway Maintenance Agreement is made and entered into by and between the State of California, acting by and through the Department of Transpntation, hereinafter referred to as -STATE,"and the City of Pleasanton, hereinafter referred to as WITNESSETLI: WHEREAS. a Freeway Maintenance Agreement, hereinafter referred to as -AGREEMENT," was executed by CITY on October 10, 1978, and by STATE on October 20, 1978: and WHEREAS, AGREEMENT by its terms provides that its Exhibit "A" may be modified or amended when a planned future improvement affects the division of maintenance responsibility; and WHEREAS, under STATE Cooperative Agreement No. 1834-C between STATE and the City of 1)ublin, improvements will be made to State Highway Route 580 at the Sari Ramon Road/Foothill Road Interchange which affects the division of maintenance responsibility between STATE and CITY under AGREEMENT; and WHEREAS. the parties hereto now desire that AGREEMENT be amended to clarify the division of maintenance responsibility upon completion of planned future improvement under said Cooperative Agreement. NOV.. THEREFORE, the parties agree to amend AGREEMENT as follows: Upon written notification by STATE to CITY that said planned future improvement is completed, the attached Exhibit "A", dated July 15, 2003 shall be substituted for the Exhibit -A- in AGREEMENT, and shall cancel and supersede the Exhibit "A" in AC;RXEMENT„ becoming a pan of AGREEMENT for all purposes. In all other respects. AGREEMENT shall remain in full loree and effect. 1
