IX. HOMEOWNER AS THIRD-PARTY BENEFICIARY <br />This Agreement is intended to benefit Residents and the Park Owner. Every Resident is <br />deemed to be a third party beneficiary of this Agreement with the authority to enforce its <br />provisions. <br />- -_ X. TERM _ - - -- - - - _ - <br />The Agreement shall take effect on January 1, 2008 and shall terminate on December 31, <br />2012. <br />XI. PROCEDURE FOR FUTURE RENT REVIEW <br />In January 2012, the City shall schedule a meeting with the Park Owner to discuss <br />whether there are terms and conditions upon which a new Agreement may be adopted. <br />XII. MAINTENANCE OF AMENITIES AND SERVICE LEVELS <br />As of the effective date hereof, the Pazk Owner provides certain amenities and service <br />levels to the Residents. The Park Owner shall not reduce these amenities or service levels <br />without meeting and conferring with the Residents prior to any reduction; provided, however, <br />that nothing provided herein shall preclude the Pazk Owner from billing Residents separately for <br />utility service fees and charges as provided in Civil Code, Section 798.41. <br />XIII. NOTICE <br />All notices herein required shall be in writing and delivered in person or sent by first <br />class mail, postage prepaid. Notices required to be given to City shall be addressed as follows: <br />City Manager <br />City of Pleasanton <br />123 Main Street <br />P.O. Box 520 <br />Pleasanton, CA 94566 <br />Notices required to be given to Park Owner shall be addressed as follows: <br />Edmund and Bazbaza Gil <br />2606 Derby Avenue <br />San Ramon, CA 94583 <br />The Pazk Owner may change such address by notice in writing to the City and thereafter notices <br />shall be addressed and transmitted to the new address. <br />8 <br />
