VIII. AGE RESTRICTION <br />Each mobilehome within Vineyard Mobile Villa must have one full-time occupant 55 <br />years of age or older. <br />IX. ANNIVERSARY DATE <br />January 1 shall be the anniversary date upon which annual rent adjustments shall be <br />effective. <br />X. HOMEOWNER AS THIRD-PARTY BENEFICIARY <br />This Agreement is intended to benefit Residents and the Park Owner. Every Resident is <br />deemed to be a third party beneficiary of this Agreement with the authority to enforce its <br />provisions. <br />XI. TERM <br />The Agreement shall take effect on January 1, 2008 and shall terminate on December 31, <br />2012 provided, however, that if the Park Owner receives approval from the City to convert Park <br />to residential ownership, then this Agreement shall terminate December 31, 2017. <br />XII. PROCEDURE FOR FUTURE RENT REVIEW <br />In January 2012 (or January 2017 if the term of this Agreement has been extended to <br />December 31, 2017), the City shall schedule a meeting of the Park Owner and the Residents to <br />discuss whether there are other terms and conditions upon which a new Agreement may be <br />adopted. <br />XIII. MAINTENANCE OF AMENITIES AND SERVICE LEVELS <br />As of the effective date hereof, the Park Owner provides certain amenities and service <br />levels to the Residents. The Park Owner shall not reduce these amenities or service levels <br />without meeting and conferring with the Residents prior to any reduction; provided, however, <br />that nothing provided herein shall preclude the Park Owner from billing Residents separately for <br />utility service fees and charges as provided in Civil Code, Section 798.41. In addition, <br />Maintenance Standards applicable to the Park are attached hereto as Exhibit D and are <br />incorporated herein by reference. Issues concerning the Maintenance Standards shall be subject <br />to the Dispute Resolution Process in Article III. <br />7 <br />
