<br />4. Cooperative Use. <br />a. Both parties agree <br />of the facility as necessary <br />Theater. The District shall provide the City with schedules <br />for major campus events, including those of an academic, <br />athletic, and other extra curricular nature. City shall <br />provide booking information relating to the Theater to the <br />District. Both parties will provide such information upon <br />request as soon as such information becomes available. Both <br />parties will cooperate to minimize avoidable conflicts. <br />c. The City shall adopt rules of use which accommodate <br />the efficient operation of the Amador campus. As an example, <br />truck loading and unloading at the Theater can be scheduled <br />to minimize interference during regular school hours. <br />5. Operational Costs: City Responsibility. <br />a. City shall pay for ongoing repair and maintenance <br />costs relating to the Theater building, including theater <br />equipment, lobbies, seats, windows, floor covering, building <br />light, painting and air conditioning and heating equipment <br />located within or upon the Theater. <br />b. City shall pay for any .part-time or full-time <br />personnel necessary for scheduling, management and related <br />administrative tasks. <br />c. City shall provide basic custodial services, <br />including basic custodial services for those times when <br />District has scheduled events in the Theater.. District may <br />be charged for custodial service and repair costs beyond <br />basic needs. <br />d. The City shall provide liability insurance for <br />injury to persons within the area controlled by the City. <br />Said insurance shall be provided in accordance with standard <br />policy limits and levels of self-insured retention which <br />apply to other similar operations of the City. The City will <br />hold harmless, indemnify and defend the District for injury <br />to persons within the area controlled by the City based upon <br />dangerous conditions of public property. Users who are <br />required by City policy to obtain an insurance policy and <br />name the City as an additional insured, shall also be <br />required to name the District as an additional insured. <br />e. The City shall be responsible for the telephone <br />system within the Theater. <br />- 3 - <br />
