<br />additions of fire safety equipment facilities and personnel, as <br />determined by City. In determining the level of participation <br />of such funding agreed to herein, City shall take into <br />consideration the Project's contribution towards fire services <br />in its ordinary contribution towards funding city services <br />generally, including but not limited to room taxes,. sales taxes, <br />property taxes, etc. <br />B. Front-End Payment. Developer shall contribute Fifty <br />Thousand Dollars ($50,000.00) to City at the time a building <br />permit, other than a foundation permit, for the Project is <br />issued. .City shall use this contribution for furnishings and/or <br />equipment for the relocated Fire Station #2 which will serve the <br />Project. If, pursuant to Section II.A. above, funding for fire <br />apparatus, manpower, or other facilities is :required in the <br />future, other than the contemplated North Pleasanton Fire <br />Improvement District which is being formed to construct the <br />relocated Fire Station #2, Developer shall be credited with <br />payments totalling Fifty Thousand Dollars ($50,000.00) and shall <br />be required to participate in such future funding only after <br />Developer's total share or shares in such funding exceeds Fifty <br />Thousand Dollars ($50,000.00). <br />III. DEVELOPER'S RIGHTS. <br />With reference to each of the agreements contained herein <br />to place the Property into one or more assessment districts, <br />benefit districts, or other district or funding mechanism <br />requiring approval of all or a majority of properties so <br />included, the Developer agrees either (1) to not protest the <br />-4- <br />
