<br />among several projects have not yet been determined, it being <br />the City's desire to .spread the total cost of the studies fairly <br />among participating projects. <br />E. Developer desires to secure building permits for the <br />Project as soon as possible, prior to the determination of the <br />manner of funding the various studies and facilities and/or <br />services required. <br />F. City may adequately protect its interest in securing <br />payment for the water and fire service studies and subsequent <br />facilities and/or services through this Agreement and finds that <br />it is in the public interest to allow Developer to proceed in <br />advance of determination of such funding. <br />NOW, THEREFORE, City and Developer hereby agree as follows: <br />I. WATER SERVICE STUDIES AND IMPROVEMENTS. <br />Developer agrees to pay its proportionate share of the cost <br />of the water service studies and water service facilities <br />necessary to serve the Property or made necessary due to the <br />cumulative development of the North Pleasanton area. Water <br />service facilities necessary shall be those identified as short- <br />and long-term improvements identified in the above-mentioned <br />water service studies and as deemed necessary by the City <br />Engineer. Developer agrees to participate in the funding of <br />such improvements in whichever manner best achieves timely <br />completion of such improvements concurrent with the development <br />of the Property. The City may require funding by (1) assessment <br />district or districts in which Developer agrees to place the <br />Property; (2) benefit district proceedings; or (3) any other <br />-2- <br />
