WIDE CONSTRUCTION EASEMENT <br /> <br /> AMADOR VALLEY JOINT UNION HIGH SCHOOL DISTRICT (hereinafter <br />"Owner") hereby grants to the CITY OF PLEASANTON (hereinafter <br />"City") or its agents, a temporary construction easement on the <br />property commonly referred to as Assessorts Parcel Number <br />946-2612-7-1 (hereinafter "Property"), more particularly shown on <br />Exhibit "A", attached hereto and incorporated herein by this <br />reference, based upon the following terms: <br /> <br /> 1. Temporary Construction Easement. The temporary <br />construction easement does not constitute a deed or grant of <br />easement, or a leasehold interest in the subject premises. No <br />fee shall be paid for this temporary construction easement. The <br />temporary construction easement shall terminate on or before <br />December 31, 1988. <br /> <br /> 2. Purpose. The temporary construction easement shall be <br />granted only for access and fencing for the purpose of completing <br />work on the Sycamore Reservoir Project. <br /> <br /> 3. Alterations. The City or its agents shall make, and may <br />cause to be made, and are allowed to make material alterations to <br />the subject real property. However, the subject real property <br />which is excavated shall be replaced with the excavated material <br />and the land, prior to December 31, 1988 shall be returned to its <br />conditions as of the date this Agreement is executed. <br /> <br /> - 1 - <br /> <br /> <br />
