EXHIBIT B-1 <br />CONDITIONS OF APPROVAL <br />PUD-99-07-03M, Donald Babbitt/Heartwood Communities <br />Serenity at Callippe Preserve (Tract 7162) <br />Happy Valley Road at its Junction with Alisal Street <br />October 18, 2006 <br />The final design guidelines for the homes to be located on the lots of Serenity at Callippe <br />Preserve (Tract 7162) shall substantially conform to the design guidelines, Exhibit A, <br />dated "Received April 6, 2006" on file with the Planning Department, except as modified <br />by the following conditions. <br />2. All conditions of Cases PUD-99-07 through PUD-99-07-02M shall remain in full force <br />and effect except as otherwise modified by this approval. <br />3. This approval including design guidelines and review procedures shall remain effective <br />for the life of the development called Serenity at Callippe Preserve or by any future <br />name, unless modified by a subsequent City action. <br />4. The project developer shall provide all buyers of the lots in Serenity at Callippe Preserve <br />with copies of the approved design guidelines and the project conditions of approval. <br />5. The following language shall be added to the design guidelines: <br />• Open fencing design should conform to the Uniform Building Code requirements for <br />fences around swimming pools, spas, etc. <br />• The subtitle on Page 18 of the Design Guidelines shall be revised to read as <br />"Accessory Structures and/or Secondary Dwellings" <br />• All homes shall be installed with an automatic fire sprinkler system; and, <br />• The 25-percent maximum floor area ratio (FAR) should include all living area, <br />garages and accessory structures on the lot. The 25-percent FAR would not include <br />the basement area provided that the basement is below grade and that only the area <br />required by the Building and Safety Division for exiting is visible from outside. In no <br />case shall the living area be greater than 7,500 square feet. <br />6. The custom homes for this development shall be subject to the review and approval of the <br />Zoning Administrator and shall conform to the design review procedures set forth by <br />Section 18.20, Design Review, of the Pleasanton Municipal Code with the following <br />exceptions: <br />a. Notice of the proposed house design applications will be sent to the Planning <br />Commission with the noticing sent to surrounding neighbors. <br />
