PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2006-55 <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF DONALD <br />BABBITT/HEARTWOOD COMMUNITIES FOR A MAJOR MODIFICATION TO A <br />PLANNED UNIT DEVELOPMENT AND FOR DESIGN REVIEW APPROVAL, <br />AS FILED UNDER CASE PUD-99-7-3M/PDR-578 <br />WHEREAS, Donald Babbitt/Heartwood Communities has applied for a major modification to <br />an approved PUD development plan for Tract 7162 (formerly TTK Properties) to <br />incorporate design guidelines for the Heartwood Communities development and <br />to modify the design review approval process; and for design review approval for <br />the construction of an approximately 7,128-square-foot two-story home with an <br />approximately 1,668-square-foot garage and a 1,088-square-foot basement on <br />Lot 8 located on Happy Valley Road at its junction with Alisal Street, within the <br />Happy Valley Specific Plan area; and <br />WHEREAS, zoning for the property is PUD-SRDR, GC, &OS (Planned Unit Development - <br />Semi-Rural Density Residential, Municipal Golf Course, and Open Space) <br />District; and <br />WHEREAS, at its duly noticed public hearing of October 18, 2006, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br />WHEREAS, the environmental review for this proposed project was undertaken with the Final <br />Environmental Impact Report (EIR) for the Happy Valley Specific Plan, approved <br />by the City Council on June 16, 1998, in conformance with the standards of the <br />California Environmental Quality Act (CEQA); and <br />WHEREAS, there are no substantial changes to the project or to the circumstances under which <br />the project is being undertaken that involve new significant environmental effects <br />or that substantially increase the severity of previously identified effects; <br />furthermore, there is no new information of substantial importance which was <br />unknown at the time that the Mitigated Negative Declaration was approved by the <br />City Council regarding the project or its effects, mitigation measures, or <br />alternatives; and any previously identified effects or impacts are mitigated to a <br />level of insignificance with the mitigation measures incorporated into the <br />project's design or imposed on the project pursuant to the conditions of approval; <br />and <br />WHEREAS, the Planning Commission determined that the proposed modification would be <br />consistent with other recently approved projects in the area and the appearance of <br />the existing buildings and would not alter the natural topographical features of the <br />area; and <br />
