EXHIBIT B CONDITIONS OF APPROVAL PCUP-179, P.F. Chang's China Bistro Restaurant 133- Stoneridge Mall Road September 13, 2006 1. The operation of the proposed use shall conform substantially to Exhibit A, dated "Received August 18, 2006", on file with the Planning Department, except as modified by these conditions. Minor modifications to the operation of the use and conditions of approval may be approved by the Planning Director if determined to be in substantial conformance with the approved use permit. 2. The P.F. Chang's China Bistro Restaurant is allowed to serve alcoholic beverages with food until 11:00 p.m., Sunday through Thursday, and until 12:00 Midnight, Friday and Saturday. 3. The P.F. Chang's China Bistro Restaurant will be operated as a restaurant/bar featuring food/beverage service only. There will be no live music, DJ music, nor dancing. The restaurant employees shall dispose of waste or recyclables in the trash enclosure area operated by the Stoneridge mall. 4. In the event that the applicant proposes to modify the hours or other aspects of the restaurant/bar operation, the modification shall be subject to the review of the Planning Director. The Planning Director may approve the modification or refer the matter to the Planning Commission if judged to be substantial. 5. The business owner or designated representative shall maintain the area surrounding the restaurant/bar and outdoor dining areas in a clean and orderly manner at all times. The business owner shall regularly monitor the area outside of the restaurant/bar to ensure peace and quiet. 6. If operation of this use results in conflicts pertaining to parking, interior or exterior noise, vibrations, traffic/circulation, litter, odors, loitering, fighting, or other factors, at the discretion on the Planning Director, this conditional use permit may be submitted to the Planning Commission for their subsequent review at a public hearing. If necessary, the Planning Commission may modify or add conditions of approval to mitigate such impacts, or may revoke said conditional use permit. The kitchen shall remain open during the operating hours of the business with the complete menu made available to restaurant patrons. The business shall comply with the Chapter 9.24 of the Pleasanton Municipal Code (Smoking in Public and Work Places).
