42. The project developer shall prepare maintenance agreements for the shared driveway <br />including the culverts bridges. The agreements shall be submitted to the City Attorney <br />for review and approval before City Council approval of the first final subdivision map <br />for this development and shall be recorded over the project site by separate instrument. <br />43. The recorded deed of sale for all lots covered by this PUD Development Plan approval <br />shall include the following: <br />a. A disclosure stating that the City of Pleasanton intends to develop and operate the <br />Alviso Adobe Park, a City park, and that the buyer recognizes that the activities that <br />take place in the Alviso Adobe Park may result in noise, odors, dust, traffic or other <br />conditions that may affect the lots covered by this PUD Development Plan. <br />b. A disclosure stating that the City of Pleasanton owns the open space area surrounding <br />Lots I through 8, that the open space area can be used by the public, and that the <br />buyer recognizes that the activities that take place in the open space area may result in <br />noise, odors, dust, or other conditions that may affect the lots covered by this PUD <br />Development Plan. <br />c. A disclosure indicating the presence of the subdrains and cleanouts and that it is the <br />responsibility of the homeowner to relocate the subdrains if encountered during the <br />excavation of a pool or other subsurface structure. <br />d. The following statement, signed by the future homeowner stating, that: <br />"You are hereby advised that this property is surrounded by land zoned and/or <br />used for the day and night-time activity relating to livestock grazing and the <br />keeping of livestock. Some of the impacts associated with this use include, but <br />are not limited to, noise, odor, dust, chemicals, refuse, waste, unsightliness, use of <br />agricultural equipment, and traffic. Permitted agricultural pursuits conducted in <br />accordance with good practice and maintenance are not deemed by the City of <br />Pleasanton to be a nuisance." <br />Wording for these clauses and/or disclosures shall be submitted to the City Attorney <br />for review and approval before City Council approval of the first final subdivision <br />map for this development and shall be recorded over the project site by separate <br />instrument. <br />44. With recordation of the final map, the project developer shall abandon access rights to <br />Old Foothill Road. <br />Building and Site Design Requirements: <br />45. The project developer shall provide automatic opening sectional roll-up garage doors <br />throughout the project, as approved by the Director of Building Inspection and the <br />Planning Director. <br />10 <br />
