The final design of the infiltration planter shall be submitted for the review and <br />approval by the Planning Director and City Engineer as part of the improvement <br />plans for the subdivision. The infiltration planter shall be designed to adequately <br />dissipate flows, as determined by the City Engineer. The applicant shall create the <br />necessary easements on the final map for Lot 1 for the infiltration planter and storm <br />drain lines to/from the infiltration planter. <br />9. The storm drain system for the development, including the infiltration planter, shall <br />be inspected annually by a Registered Civil Engineer and the results of that <br />inspection reported to the City Engineer. <br />10. All joint trench utilities (i.e., phone, cable, TV, gas, and electric) shall be stubbed to <br />the Roberts' property at 1666 Frog Hill Lane. Said modification shall be shown on <br />the subdivision improvement plans and shall be subject to the review and approval <br />by the City Engineer. The applicant shall create the necessary easements on the <br />final map for the stubbed utilities. <br />11. A maintenance association shall be created for this project. The maintenance <br />association shall be responsible for the maintenance of the private road and the <br />storm drain system for the development, including the infiltration planter. The <br />maintenance association shall run with the land and be binding on all future <br />property owners in the development. The project developer shall record CC&R's at <br />the time of recordation of the final map, which shall create a maintenance <br />association for the development. The CC&R's shall be subject to the review and <br />approval of the City Attorney prior to recordation of the final map. The City shall <br />be granted the rights and remedies of the association, but not the obligation, to <br />enforce the maintenance responsibilities of the maintenance association. <br />12. The proposed grading and retaining wall along at the southeastern corner of Lot 1 <br />shall be set back at least three feet from the common property line shared with the <br />property at 1666 Frog Hill Lane. Said modification shall be shown on the <br />subdivision improvement plans and shall be subject to the review and approval by <br />the Planning Director. <br />13. The applicant shall revise the tree replacement plan as follows: <br />a. The trees shall be spaced further apart, as space allows, to accommodate future <br />growth of the trees and shall be planted to avoid an "orchard-looking" effect <br />(e.g., cluster some trees together in a group, but then space others randomly <br />apart from each other). <br />b. Replacement trees shall be moved out of the Designated Development Areas. <br />c. Several trees shall be relocated to the north side of the EVA. <br />
