PLANNING COMMISSION CITY OF PLEASANTON
ALAMEDA COUNTY, CALIFORNIA
RESOLUTION NO. PC-2006-40
RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR JULIE AQUINO/
TUTORING CLUB OF PLEASANTON, AS FILED UNDER CASE PCUP-170
WHEREAS, Julie Aquino/Tutoring Club of Pleasanton has applied for a conditional use permit
to allow a tutoring center within a portion of the existing building located at
260 Main Street; and
WHEREAS, zoning for the property is C-C (Central Commercial) District, Downtown
Revitalization District, and Core Area Overlay District; and
WHEREAS, at its duly noticed public hearing of August 23, 2006, the Planning Commission
considered all public testimony, relevant exhibits, and recommendations of the
City staff concerning this application; and
WHEREAS, projects of this nature are categorically exempt from the requirements of the
California Environmental Quality Act (CEQA); and
WHEREAS, the Planning Commission made the following findings:
The proposed location of the conditional use is in accordance with the objectives of the
zoning ordinance and the purpose of the district in which the site is located.
The objectives of the zoning ordinance include fostering a harmonious, convenient, workable
relationship among land uses; protecting existing land use from inharmonious influences and
harmful intrusions; and ensuring that public and private lands ultimately are used for the
purposes which are most appropriate and beneficial to the City as a whole. The proposed
after-school tutorial center would provide academic instruction lessons to local students. In the
past, the City has allowed similar uses to be located in the Downtown area. No after-school
tutoring-oriented businesses have created any impacts on surrounding businesses.
The subject site is zoned C-C (Central -Commercial) district, and it is in the Downtown
Revitalization District, where it is surrounded by a mix of office/commercial/personal service
uses. Based on the proposal, the tutorial center is a quiet use as instructions would provide a
low-volume voice level, and students would focus on intensive academic tutoring. The proposed
tutoring center would not be disruptive to the neighboring businesses/tenants. Therefore, this
finding can be made.
