PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2006-31 <br />RESOLUTION APPROVING THE APPLICATION OF JOSEPH GORNY/GORNY & <br />ASSOCIATES ARCHITECTS, AND FRANK AND BARBARA BERLOGAR FOR A MAJOR <br />MODIFICATION TO A PLANNED UNIT DEVELOPMENT AND FOR DESIGN REVIEW <br />APPROVAL, AS FILED UNDER CASE PUD-OS-OIM-O1D/PDR-541 <br />WHEREAS, Joseph Gorny/Gorny & Associates Architects, and Frank and Barbara Berlogar, <br />have applied for: (1) a major modification to an approved PUD development plan <br />to replace the approved production home designs with design guidelines for the <br />Silver Oaks Estates development and to change the previous condition requiring <br />Planning Commission review/approval of the custom home designs to Zoning <br />Administrator review/approval; and (2) design review approval for an <br />approximately 4,716-square-foot single-family residence with a 909-square-foot <br />attached garage for Lot 5 of Tract 7399, located on the south side of Vineyard <br />Avenue Trail (formerly known as 2200 Vineyard Avenue) in the Vineyard <br />Avenue Corridor Specific Plan area; and <br />WHEREAS, zoning for the property is PUD-LDR (Planned Unit Development -Low Density <br />Residential) District; and <br />WHEREAS, at its duly noticed public hearing of June 28, 2006, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br />WHEREAS, the environmental review for the proposed major modification was undertaken <br />with the Final Environmental Impact Report (EIR) approved by the City Council <br />on March 1999 for the Vineyard Avenue Corridor Specific Plan in conformance <br />with the standards of the California Envirorunental Quality Act (CEQA); and <br />there are no substantial changes to the project or to the circumstances under which <br />the project is being undertaken that involve new significant environmental effect <br />or that substantially increase the severity of previously identified effect; <br />furthermore, there is no new information of substantial importance which was <br />unknown at the time that the Final EIR was approved by the City Council <br />regarding the project or its effects, mitigation measures, or alternatives; and any <br />previously identified effects or impacts are mitigated to a level of insignificance, <br />with the mitigation measures incorporated into the project's design or imposed of <br />the project pursuant to the conditions of approval; and <br />WHEREAS, the proposed residence is categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br />WHEREAS, the Planning Commission determined that the proposed modification would be <br />consistent with other recently approved projects in the area and the appearance of <br />the existing buildings and would not alter the natural topographical features of the <br />area; and <br />
