28. All utilities required to serve the proposed water tank shall be installed underground, unless <br />otherwise determined by the City Engineer. <br />29. The applicant shall submit a final utility plan for the water tank. Said plan shall be subject to the <br />review and approval of the City Engineer and the Planning Director prior to the start of <br />construction. <br />30. Any damage to existing public street or sidewalk improvements during construction shall be <br />repaired to the satisfaction of the City Engineer at full expense to the developer. This shall <br />include slurry seal, overlay, or street reconstruction if deemed warranted by the City Engineer. <br />31. The project shall comply with the Alameda Countywide NPDES Permit #CA50029831, a copy <br />of which is available at the City offices. <br />32. The project developer shall submit sizing designs criteria to treat stormwater runoff at the time of <br />plan submittal. <br />33. Prior to the start of construction, the project developer shall submit a copy of the State Water <br />Resources Control Board Notice of Intent (NOI) for coverage under the State Construction <br />Storm Water General Permit for projects with clearing, grading and excavation exceeding the <br />current standards. <br />34. The project development shall submit a stormwater Pollution Prevention Plan (SWPPP) for <br />review and approval by the City Engineer prior to the start of construction. Failure to comply <br />with the approved construction SWPPP may result in the issuance of correction notices, citations <br />or stop work order. The construction Best Management Practices (BMPs) listed in Condition <br />No. 36 below, as well as any other applicable measure, shall be included in the SWPPP and <br />implemented as approved by the City. <br />The SWPPP Plan will provide adequate BMPs for the protection of the Jurisdictional Waters of <br />the U.S. including: jute netting from the center line of the Swale to I S ft. beyond the top of bank, <br />staked hay bales at 15 fr. to 25 ft. from top of bank, and chain link fencing and silt fencing or as <br />reviewed and approved by the appropriate State or Federal agency. <br />35. The project developer is responsible for implementing the following measures during all <br />construction phases of the project: <br />a) The project developer shall include erosion control/storm water quality measures on the final <br />grading plan which shall specifically address measures to prevent soil, dirt, and debris from <br />entering the storm drain system or adjacent drainage swales. Such measures may include, <br />but are not limited to, hydroseeding, hay bales, sandbags, and siltation fences and are subject <br />to the review and approval of the City Engineer/Chief Building Official. The project <br />developer is responsible for ensuring that the contractor is aware of and implements such <br />measures. <br />
