all trees on the site that are over six-inches in diameter. Unless otherwise approved by the <br />Planning Director, the project developer and/or contractor shall comply with the <br />recommendations of the tree report. No tree trimming or pruning other than that specified in the <br />tree report and approved by the Planning Director shall occur. The project developer shall <br />arrange for the horticultural consultant to conduct a field inspection prior to tree removal or <br />grading to ensure that all recommendations have been properly implemented. The consultant <br />shall certify in writing that such recommendations have been followed. <br />16. Prior to construction, temporary six-foot tall chain link fencing or other fence type acceptable to <br />the Planning Director shall be installed around the existing trees to be saved. The final location <br />of said fencing shall be subject to the review and approval of the Planning Director. Fencing <br />shall remain in place until final inspection by the Planning Department; removal of said fencing <br />prior to that time may result in a "stop work" order. In addition, the following tree preservation <br />methods shall be followed for the existing trees to be preserved: <br />a. The applicant shall utilize his best efforts to locate any new utility trenches outside the <br />dripline of the existing trees to be saved. If this is not feasible, then the applicant shall <br />submit a report from a certified arborist acceptable to the City that indicates the trenching <br />will not be detrimental to the health of the trees. <br />b. No oil, gasoline, chemicals, or other harmful materials shall be deposited or disposed within <br />the dripline of the trees or in drainage channels, swales, or areas that may lead to the dripline. <br />c. No signs, wires, or ropes shall be attached to the trees. <br />d. No stockpiling/storage of construction materials, fill, etc., shall take place underneath or <br />within 5' of the dripline of the existing trees. <br />e. No equipment or temporary structures shall be placed within or beneath the dripline of the <br />existing trees. <br />Failure to comply with these requirements may result in a "stop-work" order. <br />17. If grading or tree removal is to occur during the raptor-nesting season (February 1 to August 31), <br />a focused survey for raptor nests shall be conducted by a qualified biologist during the nesting <br />season. The survey shall be conducted no less than 14 days and no more than 30 days prior to <br />the beginning of grading or tree removal. If nesting raptors are found during the focused survey, <br />no grading or tree removal shall occur within 500 feet of an active nest until the young have <br />fledged (as determined by a qualified biologist), or until the project applicant receives written <br />authorization from California Department of Fish and Game to proceed. If the removal of nest <br />trees is unavoidable, they shall be removed during the non-breeding season. <br />18. All construction activities shall be limited to the hours of 8:00 a.m. to 5:00 p.m., Monday <br />through Friday. In addition, no construction shall be allowed on Federal Holidays. The Planning <br />Director may allow earlier "start-times" for specific construction activities (e.g., concrete- <br />foundation/floor-pouring), if it can be demonstrated to the satisfaction of the Planning Director <br />
