Resolution No. PC-2006-27 <br />Page Two <br />The Reznick property is zoned Hillside Residential and Open Space Districts. <br />Seven residential lots are allowed by the zoning. After receiving the applicable <br />City approvals, the residential developer would use the stockpiled dirt to grade <br />this site for future development with single-family homes. The stockpiled dirt on <br />this property would make efficient use of resources since the surplus dirt from the <br />City water tank would not have to be off-hauled to a landfill or to another <br />development site across City streets and, potentially, through residential <br />neighborhoods. Furthermore, dirt would not have to be imported to this site when <br />it is graded for the future single-family homes. Therefore, this finding can be <br />made. <br />2. The proposed location of the conditional use and the conditions under <br />which the conditional uses would be operated or maintained will not be <br />detrimental to the public health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br />As conditioned, the proposed temporary dirt stockpile would not be detrimental to <br />the public health, safety, and welfare, nor will it pose a threat to surrounding <br />properties or improvements. The proposed design and location of the stockpile <br />plus the conditions of approval would mitigate potential impacts on the adjacent <br />neighbors. A condition has also been included that would require the applicant to <br />mitigate any future nuisances created by the stockpile. Therefore, this finding can <br />be made. <br />3. The proposed conditional use will comply with each of the applicable <br />provisions of Chapter 18.124 of the Pleasanton Municipal Code. <br />The zoning of the subject site allows a temporary dirt stockpile with a conditional <br />use permit. In addition, the proposed dirt stockpile complies with all relevant <br />sections of the zoning ordinance. Granting a conditional use permit to the <br />applicant would be consistent with the City's ability to regulate zoning as listed in <br />the Municipal Code Chapter 18.124. Therefore, this finding can be made. <br />WHEREAS, the Planning Commission determined that the proposed project is consistent with <br />the appearance of the existing buildings in the area, and the conditional use would <br />be compatible with the existing uses in the area. <br />
