PLANNING COMMISSION CITY OF PLEASANTON
ALAMEDA COUNTY, CALIFORNIA
RESOLUTION NO. PC-2006-27
RESOLUTION APPROVING THE APPLICATION OF THE CITY OF PLEASANTON FOR
DESIGN REVIEW APPROVAL AND CONDITIONAL USE PERMIT
AS FILED UNDER CASE PDR-520/PCUP-162
WHEREAS, the City of Pleasanton has applied for: (1) design review approval for a City
water tank to be constructed on a portion of a 20-acre site located at 5 Windy
Oaks Drive (formerly 1680 Vineyard Avenue) in the Vineyard Avenue Corridor
Specific Plan; and (2) conditional use permit to allow the temporary stockpiling of
approximately 7,000 cubic yards of excess soil from the City water tank project
on the upper portions of 5 Windy Oaks Drive; and
WHEREAS, zoning for the property is PUD-HR/OS (Planned Unit Development -Hillside
Residential/Open Space) District; and
WHEREAS, at its duly noticed public hearing of May 24, 2006, the Planning Commission
considered all public testimony, relevant exhibits, and recommendations of the
City staff concerning this application; and
WHEREAS, the environmental review for this project was undertaken with the Final
Environmental Impact Report (EIR) approved by the City Council for the
Vineyard Avenue Corridor Specific Plan in conformance with the standards of the
California Environmental Quality Act (CEQA); further, there are no substantial
changes to the project or to the circumstances under which the project is being
undertaken that involve new significant environmental effects or that substantially
increase the severity of previously identified effects; and any other previously
identified effects or impacts are mitigated to a level of insignificance, with the
mitigation measures incorporated into the project's design or imposed on the
project pursuant to the conditions of approval; and
WHEREAS, the Planning Commission made the following findings for the conditional use
permit:
1. The location of the proposed conditional use is in accordance with the
objectives of the zoning ordinance and the purpose of the district in which
the site is located.
The objectives of the zoning ordinance include protecting existing land uses from
inharmonious influences and harmful intrusions; fostering harmonious,
convenient, workable relationships among land uses; and ensuring that public and
private lands ultimately are used for the purposes which are most appropriate and
beneficial to the City as a whole. As conditioned, the proposed temporary
stockpile would be consistent with these objectives.
