PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2006-27 <br />RESOLUTION APPROVING THE APPLICATION OF THE CITY OF PLEASANTON FOR <br />DESIGN REVIEW APPROVAL AND CONDITIONAL USE PERMIT <br />AS FILED UNDER CASE PDR-520/PCUP-162 <br />WHEREAS, the City of Pleasanton has applied for: (1) design review approval for a City <br />water tank to be constructed on a portion of a 20-acre site located at 5 Windy <br />Oaks Drive (formerly 1680 Vineyard Avenue) in the Vineyard Avenue Corridor <br />Specific Plan; and (2) conditional use permit to allow the temporary stockpiling of <br />approximately 7,000 cubic yards of excess soil from the City water tank project <br />on the upper portions of 5 Windy Oaks Drive; and <br />WHEREAS, zoning for the property is PUD-HR/OS (Planned Unit Development -Hillside <br />Residential/Open Space) District; and <br />WHEREAS, at its duly noticed public hearing of May 24, 2006, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br />WHEREAS, the environmental review for this project was undertaken with the Final <br />Environmental Impact Report (EIR) approved by the City Council for the <br />Vineyard Avenue Corridor Specific Plan in conformance with the standards of the <br />California Environmental Quality Act (CEQA); further, there are no substantial <br />changes to the project or to the circumstances under which the project is being <br />undertaken that involve new significant environmental effects or that substantially <br />increase the severity of previously identified effects; and any other previously <br />identified effects or impacts are mitigated to a level of insignificance, with the <br />mitigation measures incorporated into the project's design or imposed on the <br />project pursuant to the conditions of approval; and <br />WHEREAS, the Planning Commission made the following findings for the conditional use <br />permit: <br />1. The location of the proposed conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br />The objectives of the zoning ordinance include protecting existing land uses from <br />inharmonious influences and harmful intrusions; fostering harmonious, <br />convenient, workable relationships among land uses; and ensuring that public and <br />private lands ultimately are used for the purposes which are most appropriate and <br />beneficial to the City as a whole. As conditioned, the proposed temporary <br />stockpile would be consistent with these objectives. <br />
