Resolution No. PC-2006-19 <br />Page Two <br />appropriate controls to ensure that the use does not have any negative impacts on <br />the surrounding businesses and surrounding properties. Therefore, the first <br />finding can be made. <br />2. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br />The proposed after-school program is small in scale. Based on the proposal, its <br />operation would be compatible with other uses in the shopping center as it would <br />be confined inside the building, and as its soundproofing would be added to the <br />common walls shared by other tenants. In addition, the subject facility is <br />approximately 200 feet from the nearest residential property to the south and is <br />separated from the residential neighborhood by a parking lot and a masonry wall. <br />The noise and traffic generated from the proposed tutoring center should not <br />impact the residential neighborhood. Additionally, adequate and safe ingress and <br />egress into and out of the site and sufficient on-site parking would make the <br />proposed use suitable for the subject site. Therefore, the second finding can be <br />made. <br />The proposed conditional use will comply with each of the applicable <br />provisions of the Zoning Ordinance. <br />The site's zoning regulations conditionally permit the establishment of similar use <br />to a tutoring facility. The proposed use complies with all relevant sections of the <br />zoning ordinance. Granting a conditional use permit to the applicant for an <br />after-school program would be consistent with the City's ability to regulate <br />zoning as listed in the Municipal Code. Therefore, the third finding can be made. <br />WHEREAS, the Planning Commission determined that the proposed conditional use would be <br />compatible with the existing uses in the area. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Approves Case PCUP-164, the application of Yu-Chin Chin/Young Ivy <br />Academy, Inc. for a conditional use permit to operate anafter-school program at <br />5460 Sunol Boulevard, Suites 3 and 4, and to relocate "Where the Music Begins" <br />(PCUP-141) from Suites 3 and 4 to Suite 1 in that same building, subject to the <br />conditions shown in Exhibit B, attached hereto and made part of this case by <br />reference. <br />
