PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2006-19 <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR YU-CHIN CHIN/ <br />YOUNG IVY ACADEMY, AS FILED UNDER CASE PCUP-164 <br />WHEREAS, Yu-Chin Chin/Young Ivy Academy has applied for a conditional use permit to <br />operate anafter-school program at 5460 Sunol Boulevard, Suites 3 and 4, and to <br />relocate "Where the Music Begins" (PCUP-141) from Suites 3 and 4 to Suite 1 in <br />that same building. <br />WHEREAS, zoning for the property is C-N (Neighborhood Commercial) District; and <br />WHEREAS, at its duly noticed public hearing of April 26, 2006, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br />WHEREAS, the Planning Commission made the following findings: <br />The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br />The objectives of the zoning ordinance include fostering a harmonious, <br />convenient, workable relationship among land uses; protecting existing land use <br />from inharmonious influences and harmful intrusions; and insuring that public <br />and private lands ultimately are used for the purposes which are most appropriate <br />and beneficial to the City as a whole. The subject after-school program provides <br />educational services in an enclosed area. Additionally, soundproofing would be <br />added to the common wall shared by the music studio and the immediately <br />adjoining tenant to minimize noise impacts. The proposed use would be <br />compatible in the building and, with the proposed conditions of approval, will <br />operate in a manner consistent with the above-cited objectives. <br />The site of the proposed use is located in the Oak Hills Shopping Center, which <br />permits a variety of commercial, personal service, and office uses. Establishing <br />an after-school program in this shopping center would be in accordance with the <br />purposes of the C-N zoning district to provide locations to offer commodities and <br />services to residents of Pleasanton and the surrounding residential neighborhood. <br />The proposed conditions of approval for the project would give the City the <br />
