applicability of the Personnel Rules of the City of <br /> Pleasanton to management and confidential employees who <br /> are not exempt from said Rules. <br /> <br /> Section 8: The salary and supplementary benefits set forth in <br /> this Resolution shall be the only compensation for the <br /> positions set forth in Exhibits A and B hereto and there <br /> shall be no right to receive benefits contained in any <br /> Memoranda of Understanding with the City's recognized <br /> employee organizations which are not included in the <br /> salaries and supplementary benefits set forth herein. <br /> It is the City Council's intention that there shall be <br /> mutual exclusivity between the compensation plans set <br /> forth in this resolution and the items contained in <br /> Memoranda of Understanding. <br /> <br /> Section 9: If any section, subsection, subdivision, paragraph, <br /> sentence, clause or phrase of this Resolution or any <br /> part thereof is for any reason held to be <br /> unconstitutional, such decision shall not affect the <br /> validity of the remaining portions of this Resolution or <br /> any part thereof. The City Council hereby declares that <br /> it would have passed each section, subsection <br /> subdivision, paragraph, sentence, clause or phrase <br /> thereof, irrespective of the fact that any one or more <br /> sections, subsections, subdivisions, paragraphs, <br /> sentences, clauses, or phrases be declared <br /> unconstitutional. <br /> <br /> Section 10: This resolution shall become effective upon its <br /> passage and adoption and be retroactive to October 1, <br /> 1987. <br /> <br /> THIS RESOLUTION ADOPTED OCTOBER 6, 1987 BY THE FOLLOWING VOTE: <br /> <br /> AYES: Councilmembers - Brandes, Butler, Mohr, Wilson and Mayor <br /> Mercer <br /> NOES: None - <br /> ABSENT: None NETR R~OR'~/ <br /> ABSTAIN: None <br /> <br /> ATTEST: <br /> KEN <br /> <br />~_ames R.
