B. That the proposed <br />and the conditions <br />or maintained will <br />health, safety, or <br />to the properties <br />location of the conditional use <br />under which it would be operated <br />not be detrimental to the public <br />welfare, or materially injurious <br />or improvements in the vicinity. <br />Problems have arisen during the past six years of <br />the previous use permits granted to the Game <br />Station. The problems associated with this and <br />other uses on the site cannot be eliminated <br />completely due to the nature of youth-oriented <br />uses. However, as conditioned, the conditional use <br />permit will enable the enforcement of available <br />provisions to minimize any problems associated with <br />the site. The use permit will provide the <br />opportunity for ongoing review of the operation of <br />the business and will set a "performance standard" <br />which, if not observed, will result in the <br />revocation of the use permit. The improvements to <br />the Game Station's operation which have been <br />perceived by staff and by area businesses during <br />the past six months indicate that the use is <br />currently operating with minimal adverse impact on <br />surrounding uses. <br />c. That the proposed use will comply with each of the <br />applicable provisions of this Chapter. <br />Chapter 18.124 of the Pleasanton Municipal Code <br />(Conditional Uses) states that, because of their <br />unusual characteristics, conditional uses require <br />special consideration so that they may be located <br />properly with respect to their effects on <br />surrounding properties. While the imposition of <br />reasonable conditions on the use has not had the <br />intended effect of integrating the use in the past, <br />the owner's recent efforts over the past six months <br />appear to have helped minimize the problems <br />associated with the Game Station. This has <br />resulted in a greater degree of harmony among the <br />uses at Valley Plaza. <br />WHEREAS, the Planning Commission finds that projects of this <br />nature are categorically exempt from the requirements of <br />the California Environmental Quality Act. <br />NOW, THEREFORE, THE PLANNING <br />RESOLVES AS FOLLOWS: <br />OF THE CITY OF PLEASANTON <br />Section 1. Approves Case UP-88-14, the application of <br />Larry Evans for a conditional use permit to operate <br />a game station located at 4301 Valley Avenue <br />subject to the conditions shown on Exhibit "A" <br />attached hereto and made part of this case by <br />reference. <br />
