Resolution No. PC-88-76
Page 2 - June 22, 1988
The proposed use will occupy an in-line tenant
space that is buffered from the surrounding public
roadways. As conditioned, issues concerning trash,
noise, loitering, etc. would be regulated. Hours
of operation are similar to other future uses in
the center. A pizza parlor is a typical use for a
neighborhood shopping center. The use, therefore,
would not be injurious or detrimental to the
properties in the vicinity.
C. That the proposed conditional use will comply with
each of the applicable provisions of the zoning
ordinance.
As conditioned, the proposed use will comply with
all provisions and requirements of the zoning
ordinances.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON
RESOLVES AS FOLLOWS:
Section 1. Approves Case UP-88-21, the application of Paul
Creamer for a conditional use permit to operate a take-
out food establishment and to serve alcoholic beverages
after 10:00pm on the premises to be located at 5424
Sunol Boulevard subject to the following conditions:
1. That the proposed use shall be operated in
substantial conformance with the description on
file with the Planning Department dated May 18,
1988. Hours of operation shall be 11:30am to 12
Midnight. At no time shall the use be modified
such that alcoholic beverages are sold without
food.
2. That the applicant shall be limited to a maximum of
five electronic games at one time.
3. That in the event nuisances are created through the
operation of the restaurant use, as determined by
the Planning Commission, following a hearing
process as set forth in the Municipal Code for
review and revocation of conditional uses, the City
may reugire the restaurant use to cease operation.
No loitering, public drinking or excessive vehicle
noise shall be generated by the use.
4. That the applicant be prohibited from leaving the
rear door open during operating hours. Access is
permitted, but the rear door should not remain open
for any duration during operating hours.
5. That the applicant shall maintain the area
surrounding the tenant space in a clean and orderly
manner at all times.
