Resolution No. PC-88-76 <br />Page 2 - June 22, 1988 <br />The proposed use will occupy an in-line tenant <br />space that is buffered from the surrounding public <br />roadways. As conditioned, issues concerning trash, <br />noise, loitering, etc. would be regulated. Hours <br />of operation are similar to other future uses in <br />the center. A pizza parlor is a typical use for a <br />neighborhood shopping center. The use, therefore, <br />would not be injurious or detrimental to the <br />properties in the vicinity. <br />C. That the proposed conditional use will comply with <br />each of the applicable provisions of the zoning <br />ordinance. <br />As conditioned, the proposed use will comply with <br />all provisions and requirements of the zoning <br />ordinances. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section 1. Approves Case UP-88-21, the application of Paul <br />Creamer for a conditional use permit to operate a take- <br />out food establishment and to serve alcoholic beverages <br />after 10:00pm on the premises to be located at 5424 <br />Sunol Boulevard subject to the following conditions: <br />1. That the proposed use shall be operated in <br />substantial conformance with the description on <br />file with the Planning Department dated May 18, <br />1988. Hours of operation shall be 11:30am to 12 <br />Midnight. At no time shall the use be modified <br />such that alcoholic beverages are sold without <br />food. <br />2. That the applicant shall be limited to a maximum of <br />five electronic games at one time. <br />3. That in the event nuisances are created through the <br />operation of the restaurant use, as determined by <br />the Planning Commission, following a hearing <br />process as set forth in the Municipal Code for <br />review and revocation of conditional uses, the City <br />may reugire the restaurant use to cease operation. <br />No loitering, public drinking or excessive vehicle <br />noise shall be generated by the use. <br />4. That the applicant be prohibited from leaving the <br />rear door open during operating hours. Access is <br />permitted, but the rear door should not remain open <br />for any duration during operating hours. <br />5. That the applicant shall maintain the area <br />surrounding the tenant space in a clean and orderly <br />manner at all times. <br />
