PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-88-76 <br />RESOLUTION APPROVING CASE UP-88-21, APPLICATION OF PAUL <br />CREAMER FOR A CONDITIONAL USE PERMIT <br />WHEREAS, Paul Creamer has applied for a conditional use permit to <br />operate a take-out food establishment and to serve <br />alcoholic beverages after 10:00pm on the premises to be <br />located at 5424 Sunol Boulevard; and <br />WHEREAS, zoning for the property is CN (Neighborhood Commercial) <br />District; and <br />WHEREAS, at their duly noticed public hearing of June 22, 1988, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br />WHEREAS, the Planning Commission made the following findings: <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the <br />district in which the site is located. <br />The purposes of the CN Zoning District are to <br />provide retail locations which would be patronized <br />primarily by surrounding residents, and are of a <br />design that would minimize impacts on the <br />surrounding development. A pizza parlor is a <br />typical use for a neighborhood shopping center that <br />would serve the surrounding neighbors. An in-line <br />tenant space is the best location for this use <br />because it would be buffered from adjacent public <br />streets. <br />B. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the the <br />Public health, safety or welfare, or materially <br />injurious to the properties or improvements in the <br />vicinity. <br />
