Chairperson Fox concurred with the concerns expressed by Commissioner O'Connor and <br />Commissioner Olson, especially with respect to the fluid EVA. She did not believe the other <br />alternatives were thoroughly examined. She believed the circulation in and out of the site was <br />not thoroughly discussed with respect to access points. She expressed concern about the <br />photomontages and believed that there was a concern about the 28-mm lens issue and that the <br />simulated houses were also scoped to be 6,700 square feet and were much larger than what <br />would be allowed to be built. It was her experience that people built to the largest size they <br />could. She did not believe that addressing the visual impacts of the houses individually would <br />address the impact of the project as a whole. She would like to see shots of the site with a <br />50-mm lens. She did not believe the visuals were adequate and would not be able to certify the <br />EIR based on the photomontage. When considering the project as a whole, she did not believe <br />she had sufficient information to certify the EIR. <br />Commissioner O'Connor noted that aside from the EVA issue and with respect to the trails <br />access, he believed that it was very unfair to expect the two neighborhoods to take the brunt of <br />all of the traffic to get to a huge public amenity. He believed that a permanent second access <br />area was needed for the development apart from the EVA. <br />Chairperson Fox agreed with Commissioner O'Connor's assessment. <br />Chairperson Fox moved to decline certification of the Final EIR for PUD-33, that the Final <br />EIR did not conform to the CEQA findings, and that the Environmental Findings could not <br />be made. <br />Commissioner O'Connor seconded the motion. <br />ROLL CALL VOTE: <br />AYES: Commissioners Fox, O'Connor, and Olson. <br />NOES: Commissioners Narum, Pearce. <br />ABSTAIN: None. <br />RECUSED: Commissioner Blank. <br />ABSENT: None. <br />Resolution No. PC-2007-34 declining certification of the EIR was entered and adopted as <br />motioned. <br />Chairperson Fox would like to see a document to address the issues of concern. <br />Mr. Roush noted that since the Commission had declined certification of the EIR based on areas <br />of legal insufficiency, the Commission's comments would be passed to the City Council. <br />Chairperson Fox recalled Commissioner O'Connor's earlier comments about alternative EVA <br />roads, the prominence of Court 1, as well as the three-story stepped houses. She would like to <br />see visual simulations of those houses and would like the issues of vibration and noise impacts <br />addressed. She was also concerned about the potential fire hazards.
