Findings and Recommendations Regarding Significant and Unavoidable Impacts <br />Blue Oak Woodlands (pp. 98, 108, 117-118 and 359/360). <br />The Original Project's potential impacts on blue oak woodlands are discussed in the <br />DEIR at page 108 and the Environmentally Superior Project's impacts are discussed at <br />page 359. The potential cumulative impacts are discussed at page 388 and in response <br />to comment BB3. The EIR finds blue oak woodland is the dominant plant community <br />within canyons and swales on the project site and is considered a sensitive plant <br />community. <br />The following mitigation measure is hereby adopted and will be implemented as <br />provided for in the Mitigation Monitoring and Implementation Program: Implement Oak <br />Grove Planned Unit Development (PUD-33) Mitigation Measure D7. The <br />Environmentally Superior Project's potential cumulative impacts related to the loss of <br />blue oak woodlands and heritage trees from site preparation and development activities, <br />a Blue Oak Woodland Mitigation Plan (BOWMP) shall be prepared by a qualified oak <br />restoration specialist and shall be submitted to the Planning Director for review and <br />approval before the City's action on the first Final Subdivision Map. The BOWMP shall <br />be based on an updated tree analysis for the development plan and the "Tree Report <br />For The Kottinger Hills Subdivision, Pleasanton, California", prepared by Ralph <br />Osterling Consultants, Inc., dated October 8, 2003, and shall implement the provisions <br />specified in the City of Pleasanton's Tree Preservation Ordinance and by the PUD <br />development plan approval. Implementation of the approved/accepted plan is required <br />of the project developer and the individual lot developers. <br />No further feasible mitigation is available to reduce this cumulative blue oak woodland <br />impact to aless-than-significant level. <br />Effects of Impact. <br />The Environmentally Superior Project, by removing trees within the project development <br />area, would disturb the existing distribution of trees contributing to the blue oak <br />woodland plant community on the site, and potentially interrupt the connectivity of this <br />community on the site and relation to neighboring off-site areas. <br />Remaining Impacts. <br />Implementation of Mitigation Measure D7 would provide for replacement of oak trees <br />removed or otherwise lost as a result of the project's development, and where possible, <br />oak woodland would be created in locations that are contiguous to existing oak <br />woodlands. <br />Overriding Considerations. <br />As explained in greater detail in the Statement of Overriding Considerations below, the <br />environmental, economic, social and other benefits of the Environmentally Superior <br />Page 39 of 43 <br />
