b. Mitigation Measures. <br />The following mitigation measure is hereby adopted and will be implemented as <br />provided for in the Mitigation Monitoring and Implementation Program: <br />• Implement Oak Grove Planned Unit Development (PUD-33) Mitigation Measure <br />D10. <br />c. Findings. <br />Based on the EIR and the entire record before the City, the City finds that: <br />(i) Effects of Mitigation. <br />The Environmentally Superior Project's potential project-level and cumulative impacts <br />related to the loss of heritage trees from site preparation and development activities, will <br />be mitigated to less than significant levels by the preparation of a Heritage Tree <br />Mitigation Plan (HTMP) as required by the mitigation measure referenced above. The <br />Environmentally Superior Project, as conditioned, requires that the HTMP shall be <br />prepared by a licensed arborist and shall be submitted to the Planning Director for <br />review and approval before the City's action on the first Final Subdivision Map. The <br />HTMP shall be based on an updated tree analysis for the development plan and the <br />"Tree Report For The Kottinger Hills Subdivision, Pleasanton, California", prepared by <br />Ralph Osterling Consultants, Inc., dated October 8, 2003, and shall implement the <br />provisions specified in the City of Pleasanton's Tree Preservation Ordinance and by the <br />PUD development plan approval. Implementation of the approved/accepted plan is <br />required of the project developer and the individual lot developers therefore mitigating <br />these impacts to less than significant levels. <br />(ii) Remaining Impacts. <br />Any remaining impacts related to impacts to Heritage Trees will be less than significant. <br />Cultural Resources <br />11. Loss of archeological resources (pp. 129-130 and 362/363; Condition 21 of PUD- <br />33; MMIP E1). <br />a. Potentiallmpact. <br />Previously undiscovered cultural resources may be disturbed in the course of <br />Environmentally Superior Project development. <br />b.
