9. Impact on the Movement of Any Species (pp. 110, 120 and 359/360; Condition 9f <br />of PUD-33; MMIP D9). <br />a. Potentiallmpact. <br />The Original Project's potential impacts on CTS and CRLF movement to offsite <br />breeding habitat from direct mortality are discussed in the DEIR at page 110 and the <br />Environmentally Superior Project's impacts are discussed at page 360. <br />b. Mitigation Measures. <br />The following mitigation measure is hereby adopted and will be implemented as <br />provided for in the Mitigation Monitoring and Implementation Program: <br />• Implement Oak Grove Planned Unit Development (PUD-33) Mitigation Measure <br />D9. <br />c. Findings. <br />Based on the EIR and the entire record before the City, the City finds that: <br />(i) Effects of Mitigation. <br />The Environmentally Superior Project's potential impacts on CTS and CRLF movement <br />to off-site breeding habitat from direct mortality will be mitigated to less than significant <br />levels through the implementation of the mitigation measure which requires construction <br />of Hearst Drive wildlife crossing features. These features are described in Mitigation <br />Measures D1 and D2 and, the Environmentally Superior Project, as conditioned, will be <br />required to be submitted to the Planning Director and the City Engineer for review and <br />approval before the City's action on the first final subdivision map. <br />(ii) Remaining Impacts. <br />Any remaining impacts related to impacts to CTS and CRLF movement to offsite <br />breeding habitat will be less than significant. <br />10. Conflict with the Protection of Biological Resources (pp. 111, 120-121 and <br />359/360; Condution 51-57 of PUD-33; MMIP D 10). <br />a. Potentiallmpact. <br />The Original Project's potential impacts due to the removal of up to 90 Heritage trees <br />and impacts on an additional 44 Heritage trees are discussed in the DEIR at page 111 <br />and the Environmentally Superior Project's impacts on 32 Heritage Trees are discussed <br />at page 360. <br />Page 22 of 43 <br />
