Findinqs. <br />Based on the EIR and the entire record before the City, the City finds that: <br />Effects of Mitigation. <br />• The Environmentally Superior Project's potential impacts related to the loss of <br />raptors and their habitat will be mitigated to less than significant levels through, <br />as conditioned, executing apre-construction survey 30 days prior to beginning <br />site grading to verify the presence or absence of active raptor nests. <br />Construction shall not take place if it is determined that such construction would <br />disturb an identified active raptor nest. <br />This condition shall cover the development and/or the individual building sites. <br />ii) Remaining Impacts. <br />Any remaining impacts related to impacts to burrowing owl habitat will be less than <br />significant. <br />5. Loss of Burrowing Owl and Its Habitat (DEIR, pp. 107, 116-117 and 359/360; <br />Condition 1 D of PUD-33; MMIP D5). <br />a. Potentiallmpact. <br />The Original Project's potential impacts on burrowing owl due to disturbance of potential <br />burrowing owl nesting and habitat sites are discussed in the DEIR at page 107 and the <br />Environmentally Superior Project's impacts are discussed at page 360. <br />b.
