PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-88-80 <br />RESOLUTION RECOMMENDING APPROVAL OF UP-88-26, <br />APPLICATION OF ROBERT DWYER <br />WHEREAS, Robert Dwyer has applied for a conditional use permit to <br />operate a take-out pizza restaurant and related <br />facilities to be located at 4301-D Valley Avenue; and <br />WHEREAS, zoning for the property is PUD (Planned Unit <br />Development) - Commercial District; and <br />WHEREAS, at their duly noticed public hearing of July 13, 1988, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br />WHEREAS, the Planning Commission made the following findings: <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of this <br />chapter and the purpose of the district in which <br />the site is located. <br />The proposed use is consistent with the purposes of <br />the C-N (Neighborhood Commercial) zoning district, <br />one of which is to provide appropriate uses that <br />are patronized primarily by residents of the <br />immediate area. The proposed use is described to <br />be a family oriented restaurant designed to <br />accommodate the surrounding residential <br />neighborhoods. <br />B. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, welfare, or materially injurious to <br />the properties or improvements of the vicinity. <br />
