9. Maintenance of Street A used by the public shall be shared <br />between the City and the Homeowners' Association, with the <br />respective shares determined on the basis of periodic counts <br />of actual usage of the street by each group. The method <br />selected for apportioning costs shall be satisfactory to both <br />the City Engineer and the Homeowners' Association. The proj- <br />ect CC&R's and/or agreement shall provide for the City's <br />ability to mandate street maintenance/improvements if deemed <br />necessary by the City Engineer. All maintenance shall be done <br />by the Association. <br />10. The gate/guard mechanism utilized by the Association shall <br />provide for public access to Pleasanton residents during the <br />hours the Augustin Bernal Park is open, but the park hours <br />shall not exceed daylight hours for vehicular traffic. <br />li. Eucalyptus camaldulensis shall be deleted from "Forestation <br />Trees" on Exhibit 3. <br />12. Oak species shall be greater than 50$ of the total street tree <br />planting. <br />13. "Future Guidelines" for fire management zones and lot grading <br />shall be reviewed and approved by the Planning Director prior <br />to approval of a final map. <br />14. The "Specific Guideline Notes" on Exhibit 8 shall be modified <br />as follows: <br />#2 - building within Heritage tree driplines shall follow the <br />recommendations of the tree study or those of an arborist <br />for the site-specific location <br />#3 - delete as part of the City's ordinance (but may retain as <br />part of project CC&R's) <br />15. The "General Landscape Guidelines" on Exhibit 8 shall be <br />modified as follows: <br />#5 - no solid fencing shall occur on rear property lines <br />#8 - site lighting shall conform to the detail on Exhibit 1 <br />and as required per Condition #5 of the Conditions <br />#9 - delete as part of the City's ordinance (but may retain as <br />part of project CC&R's) <br />16. The final grading plan shall save as many of the trees shown <br />as "potentially subject to impact" as feasible; no such trees <br />shall be removed without prior authorization from the Planning <br />Director, following advice from an arborist that no feasible <br />means are available to preserve the tree. All recommendations <br />contained in the Tree Survey shall be incorporated as <br />conditions of approval for this project. <br />
