That the proposed conditional use will comply with <br />each of the applicable provisions of the zoning <br />ordinance. <br />The proposed use will comply with all applicable <br />sections of Chapter 18.124 of the Pleasanton <br />Municipal Code; and <br />WHEREAS, this project is categorically exempt from the <br />requirements of CEQA. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section 1. Approves Case UP-88-40, the application of Richard <br />Woodring for a conditional use permit to construct a <br />skateboard ramp in the rear yard of an existing <br />residence at 1799 Peru Court subject to the following <br />conditions: <br />1. That the ramp be substantially as shown on the <br />plans, on file with the Planning Director unless <br />modified by the following. <br />2. That the skateboard ramp shall conform to all <br />operating limitations and design standards <br />contained in Ordinance no. 1273. <br />3. That at no time shall any additional ramps of any <br />kind be constructed and/or utilized on the site. <br />4. That if desired by the adjacent residences at 1767 <br />Peru Court, 1666 and 1698 Bivar Court, a 2' tall <br />lattice fence extension shall be installed on top <br />of the existing 6' tall good neighbor fence. The <br />responsibility for the final fence design, <br />acquiring of City permits and installation shall <br />be the responsibility of the applicant with final <br />approval by the Planning Director. <br />5. That this use permit is granted for a period of <br />five years. The use permit may be reviewed semi- <br />annually at the option of the City to determine if <br />additional conditions of operation are necessary to <br />determine compliance with conditions of approval. <br />If said conditions are determined to be violated <br />then the Planning Commission, after proper public <br />hearings, may revoke the use permit and require <br />removal of the structure. <br />6. That at no time shall any more than seven users of <br />the skateboard ramp be on site. <br />
