PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION N0. PC-88-98 <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR <br />RICHARD WOODRING AS FILED UNDER CASE UP-88-40 <br />WHEREAS, Richard Woodring has applied for a conditional use <br />permit to construct a skateboard ramp in the rear yard <br />of an existing residence located at 1799 Peru Court; <br />and <br />WHEREAS, zoning for the property is R-1-6500 (Single-family <br />Residential) District; and <br />WHEREAS, at their duly noticed public hearing of September 14, <br />1988, the Planning Commission considered all public <br />testimony, relevant exhibits and recommendations of the <br />City staff concerning this application; and <br />WHEREAS, the Planning Commission made the following findings: <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the Zoning <br />Ordinance and the purpose of the Commercial <br />District. <br />The proposed ramp would be designed, located, and <br />operated in conformance with the regulations of the <br />City's Municipal Code. As conditioned, excessive <br />noise and privacy issued should be minimized in <br />keeping with the purposes of the R-1- zoning <br />district. <br />B. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br />Location in conjunction with Code required design <br />and use restrictions should insure operation of the <br />ramp in a manner that would not be detrimental to <br />the public health, safety, etc. of the surrounding <br />properties. The structure has been oriented away <br />from adjacent residences and towards the public <br />roadway (Valley Avenue) to the north. Visual <br />impacts on the neighboring properties would be <br />minimized with additional fencing and greater <br />cumulative setbacks. <br />
