PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-88-102 <br />RESOLUTION RECOMMENDING APPROVAL OF CASE PUD-83-12-5M, <br />APPLICATION OF BAS HOMES <br />WHEREAS, bas Homes, Inc. has applied for a major modification to <br />an approved development plan for an existing residential <br />project to allow 6 foot fences to be constructed within <br />7 feet of the property line on the street side of corner <br />lots located on Lots 7, 11, 14, 15, and 19 of Tract 5445 <br />on Martin Avenue; and <br />WHEREAS, zoning for the property is PUD (Planned Unit <br />Development) - Low Density Residential District; and <br />WHEREAS, at their duly noticed public hearing of September 14, <br />1988, the Planning Commission considered all public <br />testimony, relevant exhibits and recommendations of the <br />City staff concerning this application; and <br />WHEREAS, the Planning Commission feels that the maximization of <br />the front yard areas of the corner lots does much more <br />to preserve the integrity of Martin Avenue streetscape <br />than would the existing 25 foot street side fence <br />setback. The requirement for an approved landscape plan <br />and maintenance agreement would ensure case-by-case <br />review of the side yard areas as well as their perpetual <br />maintenance. <br />WHEREAS, projects of this nature are categorically exempt from <br />the requirements of the California Environmental Quality <br />Act (CEQA). <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section 1. Recommends approval of Case PUD-83-12-5M as herein <br />described subject to the following conditions: <br />1. That 6 foot fences may be constructed on Lots 7, <br />11, 14, 15, and 19 of Tract 5445 within the 25 <br />foot yard setback, as shown on Exhibit "A" (dated <br />May 9, 1988), upon approval by the Planning <br />Director as follows: <br />a. The design of the fence to be installed along <br />the street side yard of each individual lot; <br />b. The landscape plan for the street side yard of <br />each individual lot; and, <br />
