Resolution No. PC-88-106 <br />September 28, 1988 <br />Page 2 <br />C. That the proposed conditional use will comply with <br />each of the applicable provisions of the zoning <br />ordinance. <br />As proposed and conditioned, the use complies with <br />all zoning regulations. <br />WHEREAS, this project is categorically exempt from the <br />requirements of the California Environmental Quality <br />Act. Therefore, no environmental document accompanies <br />this report. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section 1. Approves Case UP-88-46, application of Chili's, Inc. <br />for a conditional use permit to serve alcoholic <br />beverages after 10:00pm•on the site of a proposed <br />restaurant located at 4801 Hopyard Road subject to the <br />following conditions: <br />1. The proposed use shall occupy only the proposed new <br />building, J. <br />2. The proposed use shall be operated in conjunction <br />with a full-service restaurant. <br />3. No loitering, public drinking or excessive noise <br />shall be generated by the use. <br />4. The applicant shall maintain the area surrounding <br />the bar tenant space in a clean and orderly manner <br />at all times. <br />5. In the event of nuisance are created through the <br />operation of the bar's use, either within the bar <br />itself or by patrons of the bar in the vicinity of <br />the bar, the City may require the bar to cease <br />operation. Determination as to whether a nuisance <br />is created shall be made by the Planning <br />Commission following a hearing process as set forth <br />in the Municipal Code for review and revocation of <br />conditional uses. <br />6. Upon application of a bar tenant for a zoning <br />certificate, the Planning Director may choose to <br />have the actually proposed bar operation reviewed <br />by the Planning Commission.
