Peak use of recreation <br />facilities is in the evening and on weekends so the <br />operating abilities of surrounding tenants should <br />not be impacted. <br />c) That the proposed conditional use will comply with <br />each of the applicable provisions of the chapter of <br />the zoning ordinance governing this use. <br />The proposed use will comply with all applicable <br />sections of the Municipal Code. Case UP-88-57, application of Charles and Rose <br />McCracken for a conditional use permit to operate a <br />recreational facility (indoor batting range) in <br />conjunction with a proposed wholesale business <br />establishment (silk screening and embroidery) proposed <br />to be located at 7039 Commerce Circle subject to the <br />following conditions: <br />1. That the proposed use shall be substantially as <br />shown on the site plan and floor plan, Exhibit A <br />(dated October 27, 1988)on file in the Planning <br />Department. <br />2. That the applicants shall apply for and receive all <br />applicable City permits for the proposed use prior <br />to its construction and operation. <br />3. In the event that nuisances are created due to <br />parking demand as determined by staff, additional <br />conditions limiting occupancy may be implemented by <br />the Planning Director. The use permit shall be <br />valid for three years at which time the applicant <br />
