3. PGandE shall furnish and install street lighting facilities {except <br />bases and poles installed by City} within the District as shown on Exhibit "A" in <br />accordance with the provisions of PGandE's Schedule LS-1C, a copy of which is <br />attached hereto and made a part hereof. <br /> <br /> q. City shall pay PGandE prior to the furnishing of any work or materials <br />relating to the Street Lighting Service Facilities, the nonrefundable amount of $486 <br />which represents the material cost of 1,155 feet of excess conductor. <br /> <br /> 5. In addition, City shall also pay to PGandE $379,499 which is a charge <br />subject to refund for Contributions-In-Aid-of-Construction (CIAC} tax, which apply <br />to the Electric Facilities. These additional charges are necessitated due to the <br />treatment of CIAC as ordinary income by the Federal Tax Reform Act of 1986. The <br />Commission has authorized PGandE to collect the tax {67%} on CIAC. The Commission, <br />under its Order Instituting Investigation No. 86-11-019, is to rule on this tax <br />pending hearings. In the event that a lower rate is to be applied, the amount due <br />City will be proportionally refunded with interest. <br /> <br /> 6. In accordance with the Class C rates of Schedule LS-1, or such other <br />schedules as may hereafter be applicable for service to such a street lighting <br />system, City shall be responsible for service to such a street lighting system, City <br />shall be responsible for the monthly charge for service to all Street Lighting <br />Facilities installed hereunder. <br /> <br /> 7. City shall pay PGandE $15,056 which is a charge subject to refund for <br />CIAC tax covering City's installation of substructures valued at $22,472. <br /> <br /> -3- <br /> <br /> <br />
