Chairperson Fox noted that there was some discussion by Grey Eagle Court residents
regarding possible legal action and inquired whether there was sufficient exposure to
litigation to schedule a closed session for the Planning Commission prior to the open
hearing. She noted that it would be beneficial for the Commissioners to know the legal
ramifications of a decision that they might make. She continued that the City of
Livermore conducts closed sessions for its Planning Commission and expressed that the
Commission had requested the same in the past.

Mr. Roush replied that typically, matters related to possible litigation would trigger a
closed session with City Council and that he did not know whether that would occur with
the Planning Commission. He noted that he would consider that issue and report back to
the Planning Commission. Chairperson Fox noted that she would forward Minutes from
the Livermore Planning Commission for Mr. Roush’s information.

Day Lamps
Ms. Decker demonstrated the newly installed day lamps over the dais.
