Ms. Harryman noted that was a very good point and noted that was why Commissioners <br />did not want to comment on items that have already been heard by the Commission. <br /> <br />Staff Review Board <br /> <br />Commissioner O’Connor referred to a notice for the Michael Aminian subdivision of <br />three homes, which had been approved by the Planning Commission and was approved <br />by City Council. He noted that this item would be going to the Staff Review Board on <br />March 22, 2007 and requested clarification of this notice. <br /> <br />Ms. Decker described the makeup and function of the Staff Review Board for the <br />purposes of a Minor Subdivision. <br /> <br />Tutoring Center Ordinance/State Fire Marshall Classification <br /> <br />Chairperson Fox requested that before PRZ-37 went to City Council, staff check into a <br />State Fire Marshall Code interpretation service. She read: “A facility provides tutoring <br />to children ranging in ages from preschool to 18 years. The center operates two to four <br />hours a day for about 10 to 15 children at a time. What is the correct occupancy <br />classification for this type of facility?” She noted that the answer from the State Fire <br />Marshall in interpreting the Code, was, “All buildings must be classified into the <br />occupancy type they most nearly resemble. Therefore, if this facility is operated in a <br />business office building of this type, it should be classified as Group B. If operated in a <br />home, it should be classified Group R Division III occupancy.” She noted that the <br />Planning Commission had recommended 20 students and requested that staff check with <br />the State Fire Marshall to ensure that the B classification applies to 20 children. <br /> <br />Ms. Decker replied that the Planning Commission recommended that the language be <br />changed on the form such that these uses should comply with all Federal, State, and local <br />regulations. When the uses come in, the Planning Department will look into the specific <br />information of the application, and if the Fire Marshall finds that it does not comply, <br />appropriate action would be taken. She noted that Chairperson Fox’s concern was <br />covered through the requirements of the proposed ordinance. <br /> <br />Chairperson Fox wanted to ensure there were no surprises on the back end and would like <br />clarification of the type of occupancy of this use. Ms. Decker further explained the <br />process for the benefit of the Commission. <br /> <br />Valley Humane Society <br /> <br />Chairperson Fox noted that she heard that Valley Humane Society had received its <br />temporary occupancy permit.
