ROLL CALL VOTE: <br /> <br />AYES: Commissioners Blank, Fox, Narum, Olson, and Pearce. <br />NOES: None. <br />ABSTAIN: None. <br />RECUSED: None. <br />ABSENT: None. <br /> <br />Resolution No. PC-2007-31, approving PDR-563, was entered and adopted as <br />motioned. <br /> <br />b. PUD-65, Nick Kavayiotidis, Petra Realty Investors, Inc. <br /> <br />Application for Planned Unit Development rezoning and development plan to <br />construct a 21,795-square-foot two-story office building at 5980 and 5998 Sunol <br />Boulevard. Zoning for the property at 5980 Sunol Boulevard is PUD-O (Planned <br />Unit Development – Office) District, and the 5998 Sunol Boulevard property <br />would be rezoned from the O (Office) District to the PUD-O (Planned Unit <br />Development – Office) District. <br /> <br />Also consider the Negative Declaration prepared for the project. <br /> <br />Mr. Otto summarized the staff report and presented the background, scope and layout of <br />this proposed project. Staff noted that the applicant requested a change to the roof color <br />to a blend of brownish concrete tile roof with a smooth finish on the surface, which was <br />acceptable to staff. Staff had not received any public comment regarding this project and <br />believed that the building’s architecture and site layout were well done. <br /> <br />Commissioner Blank noted that the LEED points were not called out in the conditions of <br />approval. Mr. Otto advised that the Green Building Ordinance required that the building <br />be certified. Commissioner Blank had seen many projects come forward with at least <br />50 LEED points. <br /> <br />Ms. Decker noted that commercial developments were required to meet the 26-point <br />level. When projects with more points come forward, it is always a bonus, and staff <br />recognized that at the time of construction, there may be green building items that cannot <br />be procured, or substitutions may be made. Staff was reticent for the Commission to <br />condition this project to condition this project for 30 points where it may not be feasible. <br />Staff was interested in projects meeting the 26 points and had found that developers were <br />very interested in doing as much as possible. Staff believed that flexibility was an <br />important aspect in green building projects. <br /> <br />Commissioner O’Connor stated that he understood that the City wanted to synch up the <br />zonings and requested clarification on the difference between the Office District and the <br />PUD Office District. Mr. Otto replied that the two districts had varying requirements <br />regarding setbacks and parking. He added that the PUD Office District had more <br />stringent requirements than the straight Office District.
