PCUP-186, Eunhee Yoo Im, Education Enrichment Center <br /> <br />Application for a conditional use permit to operate a learning center for <br />pre-kindergarten Montessori classes and tutoring for kindergarteners and <br />elementary school students Monday through Friday from 9:30 a.m. to 7:00 p.m. in <br />an existing building located at 1024 Serpentine Lane, Suite 7-B. Zoning for the <br />property is PUD-I (Planned Unit Development – Industrial) District. <br /> <br />Ms. Decker summarized the staff report and described the background, layout, and scope <br />of this project. <br /> <br />Commissioner Blank inquired whether there was a provision for a parent who is running <br />late, such as an extra charge for late hours, and how that would be monitored with respect <br />to the State’s child care requirements. Ms. Decker replied that it would be the same as <br />any other tutoring facilities and use permits approved by the Planning Commission as <br />Consent Calendar items. If there were non-compliance with the approved conditional use <br />permit, then it would be a Code enforcement issue. The City would not actively monitor <br />these occurrences because of limited staff and police resources. <br /> <br />Chairperson Fox noted that the hours of the operation for the Montessori portion <br />appeared to total five hours a day for a total of 25 hours per week. She noted that <br />appeared to exceed the letter from the Community Care licensing division regarding a <br />drop-in center, which would not be subject to licensing requirements under 15 hours per <br />week. With respect to Title XXII exemptions, she inquired whether a printout was <br />available detailing those exemptions and whether they memorialized the 1.5 hours per <br />day limit. <br /> <br />Ms. Decker noted that the project planner, Natalie Amos, had provided a memo that <br />addressed that specific question. The State clarified that these sections referred to any <br />child who was there for more than 1.5 hours or over 15 hours per week. She noted that <br />the attendance for each child must be audited and that the total operating hours were not <br />addressed by those requirements. She noted that it was not the responsibility lay of the <br />City to determine whether a license was required.
