5. CONSENT CALENDAR <br /> <br /> <br />a. PCUP-186, Eunhee Yoo Im, Education Enrichment Center <br /> <br />Application for a conditional use permit to operate a learning center for <br />pre-kindergarten Montessori classes and tutoring for kindergarteners and <br />elementary school students Monday through Friday from 9:30 a.m. to 7:00 p.m. in <br />an existing building located at 1024 Serpentine Lane, Suite 7-B. Zoning for the <br />property is PUD-I (Planned Unit Development – Industrial) District. <br /> <br />Ms. Decker noted that staff recommended a condition of approval be added restricting the <br />use of the Education Enrichment Center as a daycare/childcare facility, and if the Center <br />intended to provide childcare facilities, a new conditional use permit shall be required <br />and approved and shall be accompanied by any applicable State licenses. She noted that <br />a staff memo had been distributed which outlined what the State licensing requirements <br />for child care were. Also attached was a 2004 letter from the State which identified an <br />exemption to the licensure requirement for a different project. She noted that letters are <br />no longer received from the State. She added that the State provided a verbal statement <br />that no childcare licensing would be required for this project. <br /> <br />Chairperson Fox advised that a speaker card had been received and that she would like to <br />remove this item from the Consent Calendar. <br /> <br />Commissioner Blank moved to remove PCUP-186 from the Consent Calendar and <br />place it on the Regular Agenda. <br />Commissioner Pearce seconded the motion. <br /> <br />ROLL CALL VOTE: <br /> <br />AYES: Commissioners Blank, Fox, O’Connor, Olson, and Pearce. <br />NOES: None. <br />ABSTAIN: None. <br />RECUSED None. <br />ABSENT: None. <br /> <br />The motion passed. <br /> <br />b. PDR-422, Duke Fuller <br /> <br /> Application for design review approval to construct an approximately 5,484- <br />square-foot single-story custom home with an approximately 767-square-foot <br />attached garage at the property located at 4134 Foothill Road.
