ROLL CALL VOTE: <br /> <br />AYES: Commissioners Blank, Fox, Narum, Olson, and Pearce. <br />NOES: None. <br />ABSTAIN: None. <br />RECUSED: None. <br />ABSENT: None. <br /> <br />Resolution No. PC-2007-10 denying PAP-103, thereby upholding PV-140, was entered and <br />adopted as motioned. <br /> <br /> <br />7.MATTERS INITIATED BY COMMISSION MEMBERS <br /> <br />Daylamps and PodCast <br /> <br />Commissioner Blank inquired if there were any updates on the daylamps and the podcast. <br />Ms. Decker replied that there were none. <br /> <br />City Manager’s Newsletter <br /> <br />Commission Olson thanked staff for sending the City Manager’s newsletter to the <br />Commissioners. <br /> <br />Opening Front Doors for Planning Commission Meetings <br /> <br />Commissioner Blank requested that the front door be opened by 6:30 p.m. on cold evenings. <br /> <br />Religious Land Use and Institutional Persons Act (RLUIPA) <br /> <br />Chairperson Fox stated that a few months ago, in connection with the Saint Clare’s Episcopal <br />Church application, Lynn Tracy Nerland had provided the Commission with some information <br />regarding the Religious Land Use and Institutional Persons Act, a federal law that overrides local <br />zoning for some situations regarding religious facilities. She noted that Redwood Christian <br />Schools was now involved in a lawsuit with the Alameda County Planning Commission and <br />Board of Supervisors in this regard. She added that the Alameda County Planning Commission <br />had challenged the constitutionality of that Act and that the matter is now in the hands of a jury. <br />She requested that staff update the Commission regarding the outcome of this case. <br /> <br />Ms. Seto replied that staff would contact the County Counsel’s Office and forward the <br />information to the Commission. <br /> <br />PLANNING COMMISSION MINUTES February 28, 2007 Page 11 of 13 <br /> <br /> <br />
