DISCUSSION: Councilmember Thorne requested bifurcating the motion and vote on the <br />ban first and the rest of it later as a substitute motion to accept the ban. <br /> <br />Mayor Hosterman agreed to the substitute motion; however, Councilmember Sullivan said <br />he was only willing to support the ban if we move with the other three options as the Mayor <br />has outlined. He questioned why the Council would not want to ask the Human Services <br />Commission or other stakeholders to further explore the issue and return with a <br />recommendation. Mayor Hosterman felt the operation would still be illegally federally, and <br />she had no problem with obtaining more information. She felt the Council should identify <br />how deep the need in the community for this type of medication and what we do with that <br />information would be up to the Council. <br /> <br />Councilmember Sullivan felt the direction would be for the Human Services Commission to <br />study community needs for medical marijuana and whether to meet that need by allowing <br />medical marijuana dispensaries. Councilmember Cook-Kallio said she had no problem <br />with going for alternative A and B; to follow the legislation on a federal level and look at <br />whether or not the bill discussed has possibilities of passing which would put medical <br />marijuana in a pharmacy. <br /> <br />Councilmember Cook-Kallio proposed instead of having it read, “and whether to meet that <br />need by allowing dispensaries in the city” this was really a council action. She suggested <br />that what should be figured out was how deep the need was in the community, and the <br />following action would be up to the Council. Mayor Hosterman wanted to give <br />Councilmember Sullivan that opportunity to vote without bifurcating the motion if at all <br />possible. She supported Councilmember Cook-Kallio’s point that separating out that one <br />issue under Option C so it would simply read, “form a task force or refer the matter to the <br />Human Services Commission to study needs for medical marijuana.” And, she felt the rest <br />of it would be in the Council’s hands. <br /> <br />Councilmember Sullivan said he was looking for a way to get more information, he was <br />open to this, but suggested saying, “to study community needs for medical marijuana and <br />whether or not it is currently being met.” <br /> <br />SUBSTITUTE MOTION AND ACTION: It was m/s by Thorne/McGovern to vote for the <br />ban separately without including additional options. Motion failed by the following vote: <br /> <br /> Ayes: McGovern and Thorne <br /> Noes: Cook-Kallio, Sullivan Mayor Hosterman <br /> Absent: None <br /> <br />Councilmember McGovern questioned that when staff comes forward, gives a report <br />twice, goes back and obtains additional information, why would the Council not trust what <br />staff provides and she felt it was wrong. If people can have it delivered to their homes and <br />can honestly have a caretaker pick it up for them. <br /> <br />SUBSTITUTE MOTION AND ACTION: It was m/s Cook-Kallio/Sullivan to introduce <br />Ordinance No. 1955 <br />adding Chapter 6.18 to the Municipal Code prohibiting the operation <br />of medical marijuana dispensaries; approved Option A to track Federal legislation <br />regarding medical marijuana and return to the Council with options if Federal law is <br />amended to allow the use of medical marijuana; and approved Option B to communicate <br /> <br />City Council Minutes 10 June 5, 2007 <br /> <br /> <br /> <br />
