Public Comment <br />Manmohan Bal addressed the City Council regarding railroad noise. He noted he has <br />been researching when quiet zones can be established and indicated with the under- <br />crossings and private crossings, the only other area where they can be established would <br />be the Castlewood public crossing, which is at-grade. He asked if there is someone on <br />staff that he could talk to about this. <br />Mayor Hosterman noted at the end meeting there is an opportunity for the Council, if there <br />is support, to direct staff to look into matters. She noted she will raise this issue tonight <br />under that part of the agenda and see what the pleasure of the Council would be. <br />Fred Norman addressed the City Council regarding military lives that have been lost in <br />Iraq. He asked for a minute of silence in their memory. <br />Shelby Margolin addressed the City Council regarding genocide in Darfur, Sudan and <br />noted she has contacted a speaker who has agreed to fly in from Los Angeles to speak <br />with the community on Thursday, April 26"' from 7 p.m. to 9 p.m. at the Amador Theatre. <br />She advised that she, along with 40 other Amador students, have taken the initiative to <br />publicize this event. She commented on their publication efforts and indicated she would <br />greatly appreciate the Council's support in any way they can. <br />Mike Hamilton addressed the City Council asking them to reconsider their decision <br />concerning Trinity Lutheran Church project. <br />Mayor Hosterman noted this is a collaborative effort and we all work together to advance <br />the very best public policy that we can on behalf of the people of Pleasanton. Whenever <br />we have opposing view points that can't come to some sort of consensus regarding land <br />use, it is not unusual for staff to try to grapple with opportunities to meet both side's <br />objectives. When that fails, it is not unusual for the Council to grapple with land use <br />process and have crafted policy to reflect what they think is best. She noted staff does a <br />wondertul job in making available to the Council every option, every opportunity possible, <br />for contemplation. In addition to that this Council will often come up with ideas of our own <br />that they will then implement. <br />City Attorney Roush spoke to motions of reconsideration in this particular instance. He <br />commented that because the approval was a conditional use permit, that type of approval <br />is not subject to reconsideration. Under the Pleasanton Municipal Code those kinds of <br />decisions go into effect immediately and therefore it is not subject to reconsideration. <br />Councilmember McGovern inquired if the church wants to appeal the decision of the <br />Council or have another review if the project, would they have any recourse. <br />Mr. Roush noted there are two courses of action; first would be that the applicant could file <br />a proceeding in the Superior Court asking the Judge to review the Council's decision. The <br />standard review would be if there is substantial evidence in the record to uphold the <br />Council's decision. The other alternative would be submittal of a revised or new <br />application to be processed in the same manner as the previous application. <br />City Council Minutes 3 April 3, 2007 <br />
